What Is SB 1383?
SB 1383, or Senate Bill 1383, is a new state law designed to reduce global warming gasses, such as methane, which are the most potent and have the most significant polluting effects.
To do so, SB 1383 aims to:
- Reduce organic waste disposal by 75% by 2025
- Rescue at least 20% of currently disposed of surplus food by 2025
Does SB 1383 Apply to You?
The law places food generators into two tiers:
Tier 1
Wholesale food vendor
Food distributor
Food service provider
Grocery store or supermarket
Tier 2
Hotel with an on-site food facility
Restaurant facility
Health provider with an on-site food facility
- State agency cafeteria
Agency with an on-site food facility
Large venue or event
As of January 1, 2022, Tier 1 food generators must donate the maximum amount of edible food to food recovery organizations (such as Feeding San Diego). Businesses in Tier 2 are required to start donating as of January 1, 2024
Understanding the Effects of SB 1383 on Your Business
If your business qualifies as a Commercial Edible Food Generator, SB 1383 requires that you:
- Recover the maximum amount of edible food by donating the surplus, rather than composting it or throwing it away
- Arrange for food recovery through a contract or written agreement with a Food Recovery Organization (such as Feeding San Diego)
- Maintain comprehensive records of:

- Types of food collected
- Frequency of donations
- Pounds of food donated per month
